... Where Buy-Cheap Threatens to Get Me Fired, Sue Me and my Employer


I bought a product 
It did not work.
I returned it after 3 days.
Does this suck?

Here is a scanned version of a letter I received from Buy-Cheap.  The red or bracketed items are my commentary or emphasis.

   Buy-Cheap threatens to get me  fired, sue for a Million dollars -- and my employer too!
 
  Buy-Cheap wrote a letter to my boss, calls me names and threatened a law suit!

   Why?  Because I returned a crappy item without asking them first...

...Buy-Cheap probably knew that this item is cheap crap... that's my opinion.  In any case, it should have known.

  Even now Mr. Glenn D'errant does not bother to proof-read his threats.

 I am writing to inform you that Softman Products LLC of Marina Del Ray, California have decided to take action against you and your racist slurs and abusive defamation of our company and intimidation of it's employees and their family members.
“Softman Products” is plural?  In American English, this is considered as singular and thus you should write Softman Products... has decided. OK, it’s a small point. BTW:  It's is an abbreviation for it is; it's not possessive.]

You are hereby requested to cease and desist from publishing any and all materials regarding holdings and services [I don’t know from holdings, but your service was great; I received the "product" practically overnight!] provided by Softman Products and any Softman employee or family member thereof in perpetuity. If you do not remove all such relevant materials published by you or any agent then we will be issuing our attorneys, Musick Peeler & Garrett LLP of Los Angeles, California, with instructions to recover the losses sustained from your actions. The lawsuit against you will also name [organization] whose resources you use and publicly conduct business with[*].  [Organization] have already been informed of your actions and have been provided ample proof and copy of your recent communications with Softman, its associated employees and their family members.
[Ditto: “ [organization] have” is plural? No; minus 2 point for grammar, so far]

 You have until Friday 13'h of May, 12:0OPM to comply with our request and provide proof that you have done so. Upon receipt of your agreement with our request we will have an agreement drawn up to assure us of your future compliance. If you do not agree with our terms the lawsuit will proceed against you personally for a minimum of one million dollars. [Friday the 13th, fish-day]

 Please contact us and inform us of the action you intend to take [against] Mr.               upon receipt of this notification. If you have not complied with our request by midday Friday 13th May 2005 we will commence proceedings against you immediately and [we will] be notifying your employer of their involvement in the suit. Thank you for your prompt reply.

I received this fax (anonymously!) on my computer 2 days later:

Evidence of Glen D'errant's proofreading is absent. 

 

Dear Mr. [my boss’s name !],

 Please find a complete transcript of all of our dealings with Mr.            , your employee. I apologize once again for the highly explicit nature [sic] of Mr            communications with our company employees, my wife and myself.

Softman products, for which I am a contractor, intend[s] to sue Mr.            Personally for $1M should he not cease and desist form publishing the content materials you find within in 3 days, I personally am a victim of Mr.             slanderous misrepresentation and abuse, which has harmed my reputation and my livelihood. My wife, who works for the Sex Offenders unit of the Los Angeles District Attorneys Office, reasonably contacted Mr.            in this regard and suffered similar abuse. My wife and I will presently be researching all and any means by which we too can prosecute Mr.            should he not cease and desist.

We find it highly disturbing that representative of [organization] having placed and been promptly [Perhaps on your Home Planet it's a prompt refund, but not in America, bub.] refunded for a $41.50 [for an] item he purchased [for $41.95] and did not like, would choose to issue charged racial slurs, persistent abuse and defamatory comments for no justifiable reason. From Mr.             communications he is unstable unreasonable and irascible man who demonstrates highly disturbing attitudes and beliefs and a demeanor very unsuited to working with human concerns for which he obviously has little regard.

We would like Mr.            dismissed from his position, as he is a liability to your clients and organization as his communications testify. Mr.            has been using your systems and resources to communicate, and he actually uses his work phone as his web contact so unfortunately  [organization] will also be named in the suit against Mr.           . We hope that this is not the necessary [sic]. Mr.            most recent and offensive communication was sent at Tue 5/10/2005 at 11:30 AM during his working hours. We are suggesting to you that be be [be be that bye-bye?]  dismissed from his current position immediately under the terms of your contract of employment with him to relive you of any liability as he is obviously publicly doing business using a [Organization] telephone number.

I have enclosed a full copy of all communications including Mr.             order information and refund from us to him. I have also included a copy of Mr.             personal website, contact and registration information as hold by WHOIS [Is you is or is you ain't a registrar WOIS?]. We are a reputable company, trading since 1997 and as Mr.             web pages appear highly ranked in Google under our Business name and key search terms, the losses we have unreasonably suffered have had a highly adverse effect on Softman Products business and employees in addition to harming me personally

 Please contact us and inform us of the action you intend to take against Mr.           . Our contact information is below.

And Glen Durrant sent a 21-page addendum to my boss, mostly of email correspondence between BuyCeap and me.

 

 

They made a big deal about this at work; some workers know already. I begged my boss to please not say anything to anyone, to no avail.  The bosses kibitzed with the Employee department;  they got the Legal department involved.  They spoke with BuyCheapSoftware's  Mr. D'Errant, who had been communicating with them them before, it seems.  I got called on the carpet big-time!  I think they may not trust me anymore, now that they've seen my "real colors" on the Internet.

Well, it's now some days past the Friday 13th deadline, it's the Sabbath day (Perhaps I won't hear from my antagonists today?).   Maybe Buycheapsoftware is only bluffing.  I need to be sure.  I now await for the aforementioned "agreement [to be] drawn up to assure them of my future compliance".  Nothing came today or yesterday.   But a supportive email was received.


 

For legal reasons, I had to put [organization] wherever my company name would normally appear; well I was asked not to drag them into this.  After the lawsuit is settled, I will post the unedited version.
